We're an air charter broker: we arrange flights, we don't operate them. Every flight is flown by a licensed carrier who is responsible for the aircraft, the crew, and the insurance. You pay that operator directly for the flight. Every price we show is an estimated total; you get one exact total before you agree to anything, and your booking page shows exactly who to pay the moment you say yes. How UpLeg is compensated is set out below and confirmed on request. Empty legs can change or cancel until the operator confirms. The full terms below are the binding version.
Welcome to UpLeg LLC (“UpLeg”, “we”, “us”, or “our”). By using our website at upleg.org and our services, you agree to the following terms and conditions. Please read them carefully.
UpLeg is an air charter broker as defined under 14 CFR Part 295. We arrange charter air transportation on behalf of our clients but do not own, operate, maintain, or exercise operational control over any aircraft. We are not a direct air carrier or direct foreign air carrier.
UpLeg arranges flights within the United States only. All flights arranged through UpLeg are operated by FAA-certificated Part 135 on-demand air carriers. The direct air carrier operating your flight is solely responsible for the safety, operation, and conduct of that flight.
UpLeg acts as an agent on behalf of the charterer (you) when arranging charter air transportation. We connect you with licensed charter operators to fulfill your flight request.
UpLeg does not hold liability insurance covering charterers, passengers, or property on charter flights. All liability insurance for flight operations is maintained by the direct air carrier operating the flight. We recommend that you confirm the operating carrier's insurance coverage and limits prior to your flight and consider purchasing your own travel insurance.
All flights listed on UpLeg are empty-leg repositioning flights and are subject to change, rescheduling, or cancellation by the operating carrier at any time. Every price displayed on UpLeg is an estimate of your total, derived from the operating carrier's public listing or from our own model, and shown as a range. It is always subject to confirmation by the operating carrier. Your exact total is confirmed with you before you agree to book. A booking request through UpLeg is a request for availability, not a confirmed reservation, until the operating carrier confirms the booking and you have agreed to the total.
Before your booking is finalized, we will provide you with the corporate name and any trade names of the direct air carrier operating your flight. Upon request, we will also disclose:
Your total is stated to you on your booking page and in the terms you agree to when you say yes. Where any part of it is payable to UpLeg directly, that is shown to you at the same moment, before you pay anyone.
You pay the operating carrier for the flight directly, under the carrier's own agreement and payment terms; UpLeg does not collect, process, or hold that money. In some bookings UpLeg directs that part of your total be paid to UpLeg instead. Where so, the amount is shown on your booking page when you say yes, and it is due after you have paid the carrier and before departure.
UpLeg is compensated for arranging bookings made through UpLeg. UpLeg's standard fee is 10% of the operating carrier's price for the flight, and no less than $500, and it may be more or less on a given booking. In most bookings the carrier collects it as part of the total it quotes you and pays it to UpLeg; in some, UpLeg directs you to pay it to UpLeg directly, as described above. If you arrange a flight UpLeg found for you, or a replacement the carrier offers in its place, directly with the carrier or through anyone else within 12 months of agreeing to book it, the standard fee remains owed to UpLeg. On request we will confirm the compensation we receive in connection with your flight and the amount of it.
Because empty-leg flights depend on the primary charter itinerary, the operating carrier may cancel or modify a flight at any time prior to departure. UpLeg does not operate the flight and cannot compel a refund from the carrier. Any refund of money you paid the carrier is governed by that carrier's own terms, which you should confirm with them before paying. We will tell you what we know about a cancellation as soon as we know it, and we will help you take the matter up with the carrier. If you wish to cancel a confirmed booking, the operating carrier's cancellation policy applies. If the carrier cancels or the flight does not operate for a reason other than your cancellation, no amount is owed to UpLeg and any amount already paid to UpLeg is refunded in full within 7 days. If you cancel, the carrier's terms govern what you paid the carrier, and any amount directed to UpLeg is owed only where the carrier's terms hold you liable for its price in full. If UpLeg fails to provide the disclosures described above within a reasonable timeframe, you may cancel your booking request with us at no cost.

UpLeg's role is limited to arranging charter air transportation. We are not liable for any acts, omissions, delays, cancellations, or injuries arising from the direct air carrier's operation of any flight. Our maximum liability to you shall not exceed any amounts actually paid by you to UpLeg.
Your use of our services is also governed by our Privacy Policy. By using UpLeg, you consent to the collection and use of your information as described therein.
We may update these terms from time to time. Continued use of our services after any changes constitutes acceptance of the updated terms.
